社会性许可权是指,受到项目影响的社会性许可被申请人对作为社会性许可申请人的项目企业以及对项目承担行政许可职责的国家行政机关所享有的某种主张或者资格。社会性许可权属于以公共利益为主的新兴权利,是一种法外权利。它不同于环境法或者行政法上的利害关系人参与权,是一种具有特定属性和独立内涵的权利。将社会性许可权转化为行政法上权利的理据在于:社会性许可权不仅是合作治理社会问题的新形式,也是实现可持续发展的重要途径,更为重要的是,实定法层面已经隐含着社会性许可权。行政法上的社会性许可权可以分为行动型社会性许可权和接受型社会性许可权,前者主要包括知情权、评论权、申请权、动议权以及表决权,后者主要包括获得通知和参加会议权、获得不利决定的理由权、不受妨碍权以及受到平等对待的权利。
The Construction of the Social License Right of Administrative Law

Abstract The right of social license refers to a claim or a qualification granted by the project business and the state administrative organization responsible for the project’s administrative license as the social license applicant for the social license applicant. The right of social license belongs to a new type of right. It is a main public interest. It is a type of right outside the law. It is different from the right of participation of interested parties in environmental law or administrative law. It is a right with specific attributes and independent connotations. The motivations of transforming the right of social license to the administrative law are that the right of social license is not only a new form of cooperation to govern social problems, but also an important way to achieve sustainable development. More importantly, the law has implied the right of social license. The right of social license of the administrative law can be divided into the activist social license right and the accepted social license right. The former mainly includes the right to know, the right to comment, the right to apply, the right to move and the right to vote. The latter includes the right to get notification and participation in meetings, the right to justification for an adverse decisions, the right to be free and the right to be treated equally.
