摘　要：

准确认定黑恶犯罪是依法推进扫黑除恶专项斗争的基本要求。我国黑社会性质组织存续的实际情况和其在整个违法犯罪构造中的地位决定了对其范围的认定应坚持限制节制的立场。黑恶犯罪构成要件的解释与认定不能偏离其本质，应注意区分“保护伞”与一般性帮助和保护行为的界限。准确认定黑恶犯罪还应重视贯彻宽严相济刑事政策，科学界定黑恶犯罪“参加”行为的含义与范围。实践中司法机关应避免以非刑法用语取代刑法规定。

 

On the Methodology of Accurate Identification of Underworld Crimes

Abstract Accurate identification of underworld crimes is a basic requirement for advancing specialized struggles against gangsters and eliminating crimes according to law. The identification of the scope of under- world organizations should be restricted as determined by the reality of their existence of in China and their status in the entire structure of illegal crimes. The interpretation and determination of the elements of gangs and evil crimes cannot be separated or deviated from their essence. The “protective umbrella” should be accurately identified and distinguished from ordinary help and protection. To identify underworld crimes accurately also requires the implementation of criminal policies with lenience and strictness, which can be exemplified in the accurate definition of the meaning and scope of “participating”. Practitioners should also avoid replacing criminal laws with non-criminal concepts.
