摘　要：

党章是根本性的党内法规，是制定其他党内法规的基础和根据。在马列主义党建思想指导下，中国共产党高度重视党章建设，自成立伊始便制定党章并不断强化党章的规范性，以党章为基础和依据形成并统一党内法规制度体系，在依规治党中根植法治的基因。中国共产党成立百年来，依规治党经历了自发产生、自主推进和自由规划的渐进历程，其中隐含的法治基因也经历了被抑制、快速壮大、显化于外并统领党建的过程。在这个过程中，中国共产党依规治党主要遵循规范体系内在统一和权力有效制约监督的法治原则。依规治党与依法治国有机结合是中国共产党治国理政的法治理念和基本方略，推动并保障了法治中国的建设。

 

The “Gene” of “Rule of Law” in Regulation-based Governance Of the CPC. and Its Century-old Historical Evolution

Abstract The CPC. Constitution is the fundamental intra-party regulation and the basis of making other intra-party regulations. Under the guidance of Marxist-Leninist thought on party building, the CPC. attaches great importance to the construction of the Constitution. Since its establishment, the CPC. has formulated and continuously strengthened the standardization of the Constitution，implanting the “gene” of “rule of law” in the process of governing the Party. Over the past 100 years, regulation-based governance of the CPC. has experi- enced a gradual process of spontaneous generation, independent promotion and free planning. The “gene” of “rule of law” has also gone through a process of being suppressed, growing rapidly and leading the construction of the CPC. Regulation-based governance of the CPC. has manifested itself as the basic principle of the internal unity of the normative system and the effective restriction of power. The organic integration of regulation-based governance of the CPC. and law-based governance of the country is the core concept and basic strategy of the CPC.’s governance, which promotes and guarantees the construction of the rule of law in China.
