数据市场已经呈现平台、数据、算法的三维竞争结构。数字平台改变了市场竞争的外在形式和内在逻辑,其作为海量、多元、实时的数据集合体,通过数字技术和算法设计获得了一定的市场影响和优势地位。传统的价格中心型分析框架因此显得僵化,新型垄断行为和市场力量的界定、竞争损害理论均因此需要重构。反垄断理论体系需反思平台经济结构,构建三元融合分析框架,以市场力量作为衡平中心,强调规制数据市场与鼓励数字平台做大做强同等重要,维护社会整体利益。
Anti-monopoly Regulation of Digital Platform

Abstract The data market has presented a three-dimensional competition structure, consisting of plat- form, data and algorithm. The digital platform has changed the external form and internal logic of market competition. As a massive and multifaceted real-time data aggregation, the digital platform has gained the power of achieving a certain market influence or dominant position through digital technology and algorithm design. In consequence, the traditional price-centric analysis framework has become rigid, and new types of monopolistic behavior, the definition of market power as well as the theory of harm to competition are all facing reconstruction. Institutional changes in the anti-monopoly theory system should return to the origin of the platform economic structure, and build a “triadic fusion” analysis framework, with market power as the center of equilibrium. With the goal of promoting the overall social benefits, strengthening the regulation of the data market is as important as encouraging digital platforms to become bigger and stronger.
