摘　要：

 在系统思维的框架下分析和探究涉外法治，需要全局性地把握涉外法治的时空方位，既看清涉外法治的外部环境，也看到涉外法治具体工作内部的框架体系。统筹推进国内法治和涉外法治回应了我国治国理政的时代要求，有助于协调构建国内法治和涉外法治，维护国家的主权、安全、发展利益，促进强国建设和实现民族复兴的伟大梦想，而且有利于实现世界和平、安全、繁荣、宽容、环保的良好秩序。涉外法治的工作体系主要体现在：第一，国家跨境法律制度的完善，包括国家在跨境立法、执法、司法、促进守法等方面的努力，以及充实法律的工具箱，依法进行国际维权。第二，国际法治合作和制度竞争，国家积极参与国际事务，提升其法治化水平和正当性程度。第三，提升国家的法治话语和叙述的水平，通过法治方式改善国家形象，提升国家声誉，展示中国作为法治大国和文明大国的形象，使中国理念与行动受到更加广泛的理解和支持。

 

Systematic Thinking on Foreign-related Rule of Law

Abstract  Analyzing and exploring foreign-related rule of law (FRRL) in systematic thinking requires an overall grasp of the temporal and spatial orientation of FRRL, a complete picture of the external environment and the working framework of the FRRL. To advance the rule of law in domestic and foreign-related affairs in a coordinated manner, as the requirement of China's governance of the times, serves to safeguard national sovereignty, security, and development interests, promote the realization of the great dream of national rejuvenation and national construction, and facilitate a good order of world peace, security, prosperity, tolerance, and environmental protection. The working mechanism of FRRL is mainly composed of: (1) the improvement of the national cross-border legal system, including unilateral efforts in cross-border legislation, law enforcement, jurisdiction, and law compliance, as well as enriching the legal toolbox and carrying out international rights protection in accordance with the law; (2) international cooperation and rivalry in the rule of law, with China actively participating in international affairs to enhance the level of legalization and legitimacy; (3) enhancing the level of China's legal discourse and narrative to boost China's image and reputation through rule of law, fully demonstrate China's image as a country with a great civilization under the rule of law and make China's ideas and actions more widely understood and supported.
