摘　要：

司法公平正义是中国式法治现代化的重要内容。大体来看，它经历了从实质正义到形式正义、再到最终确立让人民群众在每个案件中感受到公平正义的发展演变历程。这个过程，是一个不断接受公平正义的中国语境诘问，并不断进行纠偏、试错和总结经验教训的过程，因而这个过程也是坚守公平正义、先立后破，立足实践不断从“薄”到“厚”蜕变的过程，更是推动“两个结合“”两创”互融共进、重塑中国语境的过程。要实现这种从每个案件中感受到的公平正义，离不开完善的司法基本制度、司法改革的动态调试、以移情感受力与领悟能力为核心的审判能力现代化、指导性案例的指导，以及法律监督对个案正义的推动。只有这些制度联动耦合起来，形成该当的制度合力，期待中的司法公平正义才能真正得到实现。新时期中国司法公平正义的重要篇章正在被重新书写，情感叙事应当是公正司法以及中国法律话语该当的组成部分。

 

On Theoretical Expression and Realization Mechanism Of Judicial Fairness and Justice in Contemporary China

Abstract Judicial fairness and justice is an important content of rule of law in Chinese modernization. Generally speaking, it has undergone an evolutionary process from substantive justice to procedural justice and ultimately to the fairness and justice of which people are assured in every law case. This process is one of constant retrospections in the Chinese context of fairness and justice, one of continuous testing, modifying, reviewing the lessons learned, and summarizing the experience gained. Therefore, this process is also a process of long-term accumulation from practice of upholding fairness and justice in line with the principle of building the new before discarding the old. It is even more a process of reconstructing the Chinese context by promoting the coordinated advancement of integrating the basic tenets of Marxism with China's specific realities and fine traditional culture and of the creative transformation and innovative development of fine traditional Chinese culture. The fairness and justice that can be felt in every legal case cannot be achieved without a sound judicial system, dynamic adjustments to justice reform, modernization of adjudication capacity centered around sensitivity to empathy and assimilation, guidance of guiding cases, and the promotion of justice through legal supervision on a case-by-case basis. Only when these systems are linked and coupled to form the due institutional synergy can the expected judicial fairness and justice be truly practiced and realized. Emotional narrative should be a necessary component of impartial administration of justice and Chinese legal discourse; an important chapter of judicial fairness and justice in China in the new era is being written.
